MCA allowing physical filing of certain e-forms

The Ministry of Corporate Affairs (“MCA”) vide general circular no. 05/2023 dated February 22, 2023 has allowed filing of certain e- forms which are to be submitted in a time bound manner in physical mode pending the stabilization of 45 forms. The forms are to be submitted with an undertaking from the company that it will also file the relevant form in electronic mode on MCA-21 portal.

While MCA is trying to ensure that the corporate actions do not get affected due to the transition, however, with this circular it seems that MCA has taken a step backward to the era of physical filing and thereby creating duple procedure of filing of forms electronically and physically.
