Online Resolution of Disputes in the Indian Securities Market

SEBI had issued a Circular on 31 July 2023 vide Circular No. SEBI/HO/OIAE/OIAE_IAD-1/P/CIR/2023/131, to all the recognized stock exchanges, all clearing corporation, all depositories, all stock brokers, all depository participants, all listed companies and all SEBI registered intermediaries / all SEBI Regulated Entities on the subject of Online Resolution of Disputes in the Indian Securities Market. The said circular has been issued in lieu of Securities and Exchange Board of India (Ombudsman) Regulations, 2003 which had been repealed on 03 July 2023 through Securities and Exchange Board of India (Ombudsman) (Repeal) Regulations, 2023. The existing dispute resolution mechanism has been entrusted on the Stock Exchanges and Depositories (collectively referred to as Market Infrastructure Institutions (MIIs)) and for achieving the goal a common Online Dispute Resolution Portal (“ODR Portal”) has been established.
